Information management policy and protection of personal data
 

The Fund for Environmental Action and Childhood – Action Fund, is a non-profit legal entity of public utility under a private system, with full capacity to exercise rights and obligations to develop its corporate purposes.

The Action Fund was created in the year 2000 to develop a bilateral agreement between the Colombian government and the United States of America under the Initiative for the Americas.

Its corporate objective is to generate significant and sustainable changes in Colombian society in two thematic areas: (a) The conservation of biological biodiversity, promotion of sustainable and equitable development, and the protection of eco-systematic services, and (b) the protection and development of children, with emphasis on early childhood.

In compliance with the provisions of Law 1581 of 2012 and its regulations, the following Policy is established for the Management of information and protection of personal data for our clients, executors.

1. OBJECTIVE

This document is intended to formalize the personal data information processing policy for all clients, donors, executers, and persons commercially and professionally or otherwise associated with the Action Fund, guaranteeing their rights to know, update and rectify the information kept in the Action Fund´s databases or files.

2. SCOPE

This information management policy, applies to all persons and all areas of the Action Fund. Also applies to all personal information Databases and files in possession of Action Fund, under the contextual framework of Law 1581 of 2012 and its regulations.

3. DEFINITIONS

They correspond to the same definitions set forth in Law 1581 of 2012 and Decree 1377 of 2013.

4. PURPOSE OF INFORMATION MANAGEMENT IN OUR DATABASES

The Fund for Environmental Action and Childhood-Action Fund, notifies all its clients, donors, executers, and persons commercially and professionally or otherwise associated with us, that the personal data information that is currently in our database and files or  future recorded data entered through any information gathering method, will be managed in compliance with the provisions of Law 1581 of 2012, and its regulatory decree, as well as other related provisions; with the following particular purposes:

  1. To process and administer your transactions as clients, donors, executers, and persons commercially and professionally or otherwise associated with the Action Fund.
  2. To comply with the contractual obligations in the development of our contractual relations.
  3. To analyze and store information that must be aware of as future client "donor" or executor of in order to establish a contractual relationship.
  4. To analyze and store information needed for a possible professional or commercial relationship in the future.
  5. In the event of any problems additional information which will benefit the implementation of our products or services.
  6. To comply with the notification of information whenever requested by you.
  7. Offer information of new products or services directly or in conjunction with third parties.
  8. Address requests, complaints or claims to which you are entitled as an Action Fund client.
  9. The delivery of communications related to the Action Fund´s contractual activities, commercial and professionals issues such as: news bulletins, products, services, invitations, employment, advertising and surveys about our products or services.
  10. To manipulate data used by our products or services for statistical purposes, marketing or relational analysis.
  11. To manipulate data for research, innovation and the development of new products or services.
  12. Other activities related to the corporate object which must necessarily use personal information.
  13. Sharing, including transfer and transmission of your personal data to third countries for the purposes related to the operation, in compliance with the standards set by the SIC on this matter.

These activities could be executed through physical mail, electronic mail, phone or mobile devices, via text message (1 \ 1 S and / or MMS), or by any analog means and / or digital media, known or not you.

5. OWNER´S RIGHTS

As a client of our products or services, donor, executer, and person commercially and professionally or otherwise associated with the Action Fund you can exercise the following rights on the information that currently rests on our databases:

  1. To review, update and rectify any personal data to the Action Fund. This right may be exercised, among other cases for, inaccurate, incomplete, partial or misleading data, or cases in which the management of information is expressly prohibited or not authorized.
  2. Request proof of the authorization given to the Action Fund except when expressly exempted as a requisite for the management of information.
  3. Upon request, be informed by the Action Fund about the use it has been given to your personal data.
  4. Submit to the Industry and Commerce Superintendence (SIC), complaints for violations to the provisions of the present law and other regulations that modify, add or supplement it.
  5. Revoke the authorization and/or request the deletion of the data when the management of information principles, rights and constitutional and legal guarantees are not observed. The impeachment and/or deletion will proceed when the Superintendence of Industry and Commerce determines that the Action Fund engaged in conducts contrary to the law and the Constitution.

6. OBLIGATIONS

6.1. Action Fund Obligations:

  1. Guarantee the owner the full and effective exercise of the habeas data right at all times.
  2. Request and maintain a copy of the respective authorization granted by the Owner, in compliance with Law 1581 of 2012
  3. Duly inform the Owner of the purpose of the information gathering and the rights by virtue of the authorization granted.
  4. Keep the information under the necessary secure conditions to prevent its adulteration, loss or unauthorized or fraudulent use or access
  5. Ensure that the information is truthful, complete, accurate, up-to-date, understandable and verifiable.
  6. Update the information; including all the new information related to data previously provided and to take other necessary steps to ensure that the information is updated.
  7. Rectify erroneous information.
  8. Use only data when previously authorized and within the provisions of the present law.
  9. Ensure at all times the security and privacy conditions of the Owner´s information.
  10. Process all inquiries and complaints made under the terms and conditions set forth by this law.
  11. Adopt internal policies and procedures manual to ensure proper compliance with the present law and in particular to address inquiries and complaints.
  12. Report to the Owner about the use of their data.
  13. To inform the data protection authority when there have been violations of the codes and security risks in the administration of the Owner´s information.
  14. To comply with the instructions and requirements demanded by the Superintendence of Industry and Commerce.

6.2. Duties of the Action Fund´s staff responsible for management of information:

  1. Guarantee to the Owner of the information the full and effective exercise of their habeas data rights at all times.
  2. Keep the information under the necessary secure conditions to prevent its adulteration, loss or unauthorized or fraudulent use or access.
  3. Undertake timely updating, correction or deletion of the data in accordance with the terms of this law.
  4. Update the information reported, within five (5) working days from the receipt.
  5. Process the requirements and the claims made by the owners in the terms and conditions set forth by this law.
  6. Adopt internal policies and procedures manual to ensure proper compliance with the current law and in particular to address inquiries and complaints.
  7. Register in the database the legend "claim pending" in the method regulated by law 1581 of 2012, and its respective legislation.
  8. Insert into the database the legend "judicial information in discussion" once notified by the competent authority on judicial processes related to the quality of the personal data.
  9. Refrain from circulating information that is being contested by the Owner and that has been blocked by an order from the Superintendence of Industry and Commerce.
  10. Allow access to the information only to those entitled to it.
  11. To inform the Superintendence of Industry and Commerce when there have been violations of the codes and security risks in the administration of the information.
  12. Comply with the instructions and requirements demanded by the Superintendence of Industry and Commerce

7. REQUESTS, QUESTIONS AND COMPLAINTS

7.1. Responsible Area

The Action Fund through its Legal Department and with the support of the Systems Coordinator, will address all requests, queries, and/or claims from the owner of the information, as they relate to the rights set forth by the law to review, update, rectify and delete information or revoke the authorization granted to the Action Fund regarding their personal data.

7.2. Procedures to claim rights

To exercise their rights the owners of the information may submit requests, queries and/or claims through the following mechanisms:

8. CURRENT REGULATIONS

This Information Management Policy is governed under the provisions of Law 1581 of 2012 and decree 1377 of 2013 and other modifying regulations.

9. VALIDITY

This policy is in effect as of July 20 2013.

It is in the interest of the Action Fund, to protect the privacy of the personal information of our clients, donors, executers, and persons commercially and professionally or otherwise associated with the organization and therefore commits itself to adopt a policy of confidentiality and security as set forth below:

Our Privacy Policy describes how the Fund will manage and handle the personal information of its clients, donors, executers, and persons commercially and professionally or otherwise associated with the organization contained in its databases.

The Owners of personal data acknowledge that they provided the information voluntarily, knowing and accepting that such information will be part of a database that will contain the information records, which will be used by the Action Fund, in the development of the functions carried out to fulfill its corporate objective. However the owners of this information may request that it be changed or updated at any time.

1.  PERSONAL DATA COLLECTION PROCESS FOR CLIENTS, DONORS, EXECUTERS, AND PERSONS COMMERCIALLY AND PROFESSIONALLY OR OTHERWISE ASSOCIATED WITH THE ORGANIZATION FUND.

1.1. Data Collection Method

The personal information of our clients, donors, executers, and persons commercially and professionally or otherwise associated with the Action Fund is provided by the owner during the development of the functions of this organization, in its capacity as a nonprofit profit organization and to fulfill its corporate objective.

1.2. Collected Data
Data stored by the Action Fund depends on the type of association established with clients, donors, executers, and persons commercially and professionally or otherwise associated with the organization and the products and services offered. The owner acknowledges that for the proper management of the contractual relationship, professional or business relationship derived from our corporate objet, it is necessary to collect data such as: the name and address of the individual or legal entity, identification number or NIT, RUT, bank account, address, telephone, email and personal contact data.

The Owner of the information declares that all the information that has submitted to the Action Fund, is correct and truthful, and authorizes the good use of the same according to the terms of this policy, safeguarding the privacy of the data submitted and the other rights derived from Law 1581 of 2012 and other related regulations.

1.3. Justification

Unless the Owner states otherwise, the Action Fund may use the personal information for purposes derivative from our corporate objective and in the terms in which it has been indicated in the Information Management and Privacy Policy. Owners of such information may request at any time to be removed from our database.

1.4. Information use

Systematized collection and processing of personal data by the Action Fund will be carried out for purpose of fulfilling  the contractual obligations, supplying products and services required, processing transactions as clients, donors, executers, and persons commercially and professionally or otherwise associated with the Action Fund, to offer information, directly or through a third party of new products or services, sending communications such as news bulletins, invitations to events, employment information, advertising, requests, complaints or claims that you are entitled to as a client of the Fund, as well as the management, administration, delivery, expansion and improvement of services, with due respect, in any case, to the existing legislation on protection of personal data.
 

According with the current legal regulations in the field of data protection law 1581 of 2012, the user expressly agrees that the personal data provided to the Action Fund through its different formats and tools be incorporated into the Action Fund´s database. In the case of commercial or contractual communications via e-mail or equivalent, the user expressly agrees that this information could be sent through such mechanisms.
 

The Action Fund is committed to the fulfillment of its obligations with respect to the confidentiality of the personal data. For this purpose commits itself to adopt technical, organizational and security measures to prevent the alteration, loss, unauthorized management or access to the personal data, in compliance with the current Colombian law.

The owner of the information can at any time exercise the right to access, rectify and cancel the personal data submitted through a written request, attaching a legible photocopy of the identification. This request should be directed to habeasdata@fondoaccion.org or to Cra 7ª No. 32-33, 27th Floor, Bogotá, Colombia.

2. DATA OF A PERSONAL NATURE INCLUDED IN THE DATABASES OF THE ACTION FUND

2.1. Personal Information Security

The Action Fund protects the personal information that collects in a secure database. In the storage of information, we have taken a series of measures to protect your personal information from misuse, loss, unauthorized access, modifications or disclosure. The Action Fund uses firewalls, intrusion detection systems, and tools for the detection of viruses to protect data against unauthorized persons. Likewise, the Action Fund´s employees and contractors are required confidentiality in handling all the information, which will be available for its use strictly in carrying out their assigned functions and activities. They are also compelled to use user names and passwords to access the databases and systems.

2.2. Information Access and Correction

Under the habeas data Law, you have the right to request access to your information in the Action Fund. You also have the right to request corrections for incomplete or outdated data. You can access the information that the Action Fund has been gathering through a written request sent to the contact details above. Please include your phone number and attach a copy of your identification. Our Policy considers all the requests for access or corrections under the terms indicated by the law of habeas data.
 

When you access the web sites, the Action Fund takes seriously its obligations of privacy. The Action Fund will be responsible for managing the personal information collected through this method, in the same manner as it deals with the personal information collected personally.

If the Action Fund gives your personal information to third parties, the latter is compelled to comply with the Information Management and Privacy Policy, under the strict conditions that regulate the use and manipulation of personal information.

In some occasions, for your convenience and information, our web site contains links to third party web sites. When you access a web site from a third party, please understand that the Action Fund is not responsible for the privacy practices of that site. We suggest you review the privacy policies of each site you visit.

The Action Fund manifests that it has implemented the appropriate mechanisms to provide security to the information collected and has made the best efforts to ensure diligently and prudently the maintenance of such security measures. However, the owner of the personal information recognizes that technological means can involve risks which assumes and accepts. Therefore the Action Fund cannot provide a total guarantee, nor can it assume any responsibility for any consequence resulting from any illegal access to the database and / or for any technical malfunction and / or safekeeping of the data system.

Habeas Data Authorization Law 1581 of 2012
 
Our Company has in its database information previously provided by you and / or your organization, which has been collected because of the contractual relationship generated in the development of the our corporate objective.

The Action Fund wishes to state that it guarantees at all times the fundamental rights such as the Habeas Data, privacy, intimacy, good name, and to that end, all actions in the collection, processing and circulation of data will be guided by the principles of good faith, legality, freedom, purpose, truth, transparency, access and restricted circulation, security, confidentiality and self-determination information according to the Colombian legal system for the management of personal data.

With the enactment of Law 1581 of 2012 "Whereby the general provisions for the protection of personal data are issued", and Decree 1377 of 2013 which partially regulates it, we require your authorization for the management of your personal data which is reported to a database for which we are responsible, and that will be used directly or through third parties under our responsibility, in the development of the functions of this organization, as a nonprofit organization domiciled Carrera 7 No. 32-33 27th floor, Bogotá, Colombia, Switchboard (57-1) 2853862 • Fax (57 -1) 2454145 and email: habeasdata@fondoaccion.org.

According to the above regulations, at any time you may exercise your right to know, update, correct or request removal of your personal information from our database. On the terms provided for by article 10 of Decree 1377 of 2013, the Action Fund is authorized expressly and unequivocally to maintain and manage all your information. However, if you want your information to be removed from our database, we request a direct, clear a unequivocal manifestation in writing within thirty (30) working days of receipt of this communication, through an email to the following address: habeasdata@fondoaccion.org.

The Action Fund, understands that the personal data is the property of the owner and that only the owner can decide over it. Thus, the Fund will make use of the information only for the purposes for which the Action Fund is allowed, always in accordance with the law and the current regulations on the protection of personal data. Also, to take the technical, human and administrative measures necessary to provide security for the records, while avoiding its adulteration, loss, enquiry, access or unauthorized or fraudulent use.
